An industrial design refers to the visual features of a product which can include the shape, configuration, pattern, or ornament of a product which is applied to such product by an industrial process. Such design adds value to a product and makes it more aesthetically appealing and attractive to customers, thereby enhancing its selling point. In Malaysia, an industrial design is registrable if the design fulfils the definition of an industrial design, possesses worldwide novelty and is not contrary to public order or morality.
the owner obtains the exclusive right to exploit the design and prevent unauthorized copying or imitation by others, thereby improving competitiveness and strengthening market position of its product. Registering a design can also contribute to the return on investment made in developing and marketing the product through licensing and sale. The initial protection period of a registration is 5 years and is extendable for a further 4 consecutive terms, bringing the maximum protection to 25 years.
We have a team of experienced professionals who are able to advise on and secure industrial designs registrations both in Malaysia and abroad.
